Bank Collectors will get Protection from aggressive Russian Clients
Defending extortionists instead of social policies
Employees of banks and collection agencies will be able to interact with debtors without giving their full names – claimants will have the right to introduce themselves to citizens using digital identifiers, RBC informs.
Such an opportunity was described in the working version of the draft Federal Law “On Activities on the Return of Overdue Debts of Individuals”. The changes, according to employees of the Ministry of Justice, will contribute to “protecting the personal data of employees of collection agencies and representatives of creditors”.
The current law on debt collection obliges collectors to present themselves at the beginning of a conversation with debtors. Before mentioning the debt, the specialist must give the last name, first name and patronymic. The new law, developed by the Ministry of Justice with the participation of the Federal Bailiff Service and business representatives, allows employees to name only their name and number identifier when interacting with the client.
“Collectors are very afraid to disclose the names of ordinary call center employees. If the debtor is nervous, they can direct their aggression to the caller. Such cases have been mentioned in the news. At the same time, employees who call clients, usually do not make decisions regarding their debts at all. Decisions are made by the management,” said RBC Chairman of the Financial Security Commission of the Chamber of Commerce, Ivan Rykov.
It will become much more difficult for Russians to hold collectors accountable in case of illegal actions.
“Not a single person will remember the set of numbers; most people do not record their conversations. Also, the name of a specific employee may be necessary when filing a complaint, ”said Oleg Zaitsev, chairman of the Bankruptcy Club Law Association, in an interview with RBC.
Since 2010, the debts of Russians have grown six times. The first loan is followed by the second one, taken with the goal of repaying the first one – citizens are impoverished, capital is still pumping a debt “bubble” and does not want to abandon the still profitable financial model. Russian capitalism is increasingly resorting to forceful methods of knocking money out of citizens. Utility bill debtors can also be transferred to collectors.
